[size=13.3333px]he country’s supreme court on 27th Sep 2018 Struck down a colonial-era law that prescribed a maximum imprisonment of five years to men for adultery. However, the offence still remains a valid ground for divorce.
[size=13.3333px]The five-judge Constitution bench of the Supreme Court was unanimous in striking down Section 497 of the Indian Penal Code (IPC) dealing with the offence of adultery and holding it as manifestly arbitrary, archaic law which is violative of the rights to equality and equal opportunity to women.
[size=13.3333px]Adultery was punishable by a maximum five years in jail or fine or both under Section 497 of IPC.
[size=13.3333px]"We declare Section 497 IPC and Section 198 of CrPC dealing with prosecution of offences against marriage as unconstitutional," Chief Justice of India Dipak Misra, who wrote the judgement for himself and Justice Khanwilkar, said.
